By downloading, installing, or using the BodyArc application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
You must be at least 13 years old to use this App. If you are under 18, you must have parental consent.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You must create an account to use the App. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion, with or without notice.
The App collects and stores health-related data you provide. By using the App, you consent to the collection, storage, and processing of this information as described in our Privacy Policy.
You acknowledge that the App relies on user-inputted data and device sensors, which may not always be accurate. BodyArc is not responsible for any inaccuracies in tracked data.
We are not responsible for any loss, corruption, or deletion of your data. You acknowledge that you are solely responsible for maintaining backups of your health information. We strongly recommend keeping independent records of important health data.

THE APP IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR HEALTH CONDITION. THE INFORMATION PROVIDED BY THE APP SHOULD NOT BE USED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE. ALWAYS CONSULT YOUR HEALTHCARE PROVIDER BEFORE MAKING ANY HEALTH-RELATED DECISIONS.
BodyArc makes no representations about the accuracy, reliability, completeness, or timeliness of any information provided through the App.
All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of BodyArc or its licensors and are protected by intellectual property laws.
You retain ownership of any content you submit to the App. By submitting content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and distribute your content in connection with operating and improving the App.
If you believe your copyright has been infringed, please contact us at support@bodyarc.ai with the required DMCA information.
The App may integrate with third-party services (such as fitness trackers or health platforms). Your use of such services is governed by their respective terms and privacy policies. We are not responsible for third-party services or their practices.
The App may offer both free and premium subscription tiers. Premium features require payment according to the pricing displayed in the App.
Subscription fees are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees due. All payments are non-refundable except as required by law.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
We reserve the right to change subscription prices upon 30 days' notice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BODYARC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL BODYARC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS OR $100, WHICHEVER IS GREATER.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
You agree to defend, indemnify, and hold harmless BodyArc, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements, including without limitation reasonable legal and accounting fees, resulting from or alleged to result from your violation of these Terms or your use of the App.
Any dispute arising out of or relating to these Terms or the App shall be resolved through binding individual arbitration in accordance with the rules of [Arbitration Organization], except where prohibited by law. The arbitration shall be conducted in [Jurisdiction].
YOU AGREE THAT ANY DISPUTES SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate multiple persons' claims or engage in any class arbitration.
Notwithstanding the above, either party may bring an individual action in small claims court.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms in the App and updating the "Effective Date." Your continued use of the App after such changes constitutes acceptance of the new Terms.
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in [Jurisdiction].
You agree to comply with all applicable export and import laws and regulations. You represent that you are not on any government list of prohibited or restricted parties.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations without our written consent.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BodyArc regarding the use of the App and supersede all prior agreements and understandings.
